Travel Release & Liability Waiver

I choose to participate in a GoodWorld Journeys Salon on the Greek isle of Patmos. I hereby freely and voluntarily, without duress, execute this Travel Release & Waiver of Liability (the “Release”) under the following terms:

Travel Release & Waiver: I release and forever discharge and hold harmless GoodWorld Journeys (hereinafter referred to jointly as GWJ) and its affiliated organizations, partners, directors, officers, employees, representatives and agents, and their successors and assigns, from any and all liability, claims, and demands of whatever kind or nature, either in law or in equity, which arise or may hereafter arise from my participating in a GWJ program and related activities, whether such liability, claims, or demands result from travel, disease, consumption of food, or from civil unrest or otherwise.

I understand and acknowledge that this Release discharges GWJ from any liability or claim against it with respect to any

bodily injury, personal injury, illness, death, monetary loss or property damage that may result from my participation in a GWJ program. I understand that GWJ assumes no responsibility for or obligation to provide financial assistance or other assistance, including but not limited to medical, health, or disability insurance, in the event of injury, illness, death, accident, monetary loss or property damage.

GoodWorld Journeys, its employees, subsidiaries, affiliates, officers, directors, successors, representatives, assigns and its designated tour operators shall not be held liable for (A) any damage to, or loss of, property or injury to, or death of, persons occasioned directly or indirectly by an act or omission of any other provider, including but not limited to any defect in any aircraft, watercraft, or vehicle operated or provided by such other provider; and (B) any loss or damage due to delay, cancellation, or disruption in any manner caused by the laws, regulations, acts or failures to act, demands, orders, or interpositions of any government or any subdivision or agent thereof, or by acts of God, strikes, fire, flood, war, rebellion, terrorism, insurrection, sickness, quarantine, epidemics, theft, or any other cause(s) beyond their control. I waive any claim against GoodWorld Journeys and/or its designated tour operator for any such loss, damage, injury, or death.

By registering for a GoodWorld Journey, I certify that I do not have any mental, physical, or other condition or disability that would create a hazard for myself or other participants. I understand that GWJ reserves the right in their sole discretion to accept, decline to accept, or remove any participant on a GoodWorld Journey. I understand that GWJ reserves the right, without penalty, to make changes in the published itinerary whenever, in their judgment, conditions warrant or if they deem it necessary for the comfort, convenience, or safety of participants. I also understand that GWJ shall not be liable for any air or watercraft carrier’s cancellation penalty incurred by the purchase of a nonrefundable ticket to Greece or Patmos.

Medical Treatment Authorization & Coverage: I hereby release and forever discharge GWJ from any claim whatsoever which arises or may hereafter arise on account of any first-aid treatment or other medical services rendered to me or to my dependent/companions in connection with an emergency or health problem during my participation in a GWJ program. In the event I become sufficiently incapacitated as to be unable to direct my own care, there is no one on the trip who can direct my care, and GoodWorld Journeys is unable or does not have time to reach my emergency contact, the participant, by registering and paying a for GWJ program, I authorize any medical treatment deemed necessary in the event of any injury or illness while participating in the activity including, but not limited to, X-ray, examination, anesthetic, medical or surgical diagnosis, or treatment and hospital care which is deemed advisable by, and is to be rendered under the general or specific supervision of, any physician and/or surgeon licensed in the United States, or, if in a foreign country and no physician licensed to practice in the United States is reasonably available, by a duly licensed physician deemed competent to render the necessary care. In addition, I certify that I have medical insurance which will cover personal accidents, medical expenses, medical evacuation, air ambulance, loss of effects, repatriation costs and all other expenses which might arise as a result of loss, damage, injury, delay or inconvenience occurring to me, or that in the absence of this medical insurance coverage, I agree to pay all costs of rescue and/or medical services as may be incurred on my behalf.

Assumption of Risk: I understand that my participation in a GWJ program may include activities and circumstances that may be hazardous to me, including, but not limited to, international travel, local transportation in the country of my travels, poor health conditions, inadequate medical treatment facilities and other inherent dangers. I recognize that I may be traveling to and from locations that pose risks from terrorism, war, insurrection, or criminal activities. I hereby expressly and specifically assume the risk of injury, illness, death, monetary loss or property damage resulting from such circumstances during my participation with a GWJ program, whether suffered by me personally or by any of my accompanying dependents or companions.

Other: I agree that in the event that any clause or provision of this Release shall be held to be invalid by any court of competent jurisdiction, the invalidity of such clause or provision shall not otherwise affect the remaining provisions of this Release which shall continue to be enforceable. I understand that any dispute concerning this Release that shall continue to be enforceable.

Dispute Resolution: If the participant has a complaint, he/she should first inform GWJ while on the program so that the GWJ leaders can attempt to rectify the matter. If the participant is still dissatisfied, he/she should submit the complaint in writing to GWJ within 30 days of the completion of the program. Any controversy or claim arising out of or relating to this Agreement, GWJ website, or any other literature concerning this program, or the breach thereof, including without limitation any claim related to illness, injury, or death, shall be subject to the following conditions: 1) the dispute will be governed by California law; 2) the parties agree that they will attempt in good faith to settle any and all disputes arising out of, under or in connection with this Agreement, including without limitation the validity, interpretation, performance and breach hereof, through a process of mediation in San Francisco, CA under the supervision of a mutually agreed upon mediator; 3) in the event that mediation fails to settle such a dispute, the parties agree that they will proceed to arbitration in San Francisco, CA. using one arbitrator pursuant to the then existing rules of the American Arbitration Association; 4) the maximum amount of recovery to which a participant will be entitled under any and all circumstances will be the published cost of the participant’s expedition with GWJ. This agreement to arbitrate does not waive or modify any liability release agreed by the participant.
